Terms of Service

Fuzzball is a competitive game meant to be played by real people, against real people, in good faith. By playing, you agree to act respectably toward other players and Avolans staff: no harassment, no abuse, no exploiting bugs or desyncs to gain an unfair advantage, and no attempts to manipulate matchmaking, ratings, or leaderboards.

Fuzzball is for human players only. You may not use, build, or connect any bot, script, macro, AI agent, or other automated or semi-automated system to control, monitor, or otherwise interact with the service — including but not limited to playing matches, farming ratings or rewards, or scraping gameplay or leaderboard data. Accounts and devices found doing so may be suspended or removed under the Suspension & termination section below.

You may play as a signed-in account (linked to Apple, Google, or Game Center) or as a guest tied to your device. Either way, you're responsible for the activity that happens under your account or from your device, including anything that happens if you share access with someone else.

You must provide accurate information, keep your credentials and device secure, and promptly notify us of suspected unauthorized use. Accounts, player identities, nicknames, ratings, cosmetics, entitlements, and other Service features are personal, revocable permissions to use the Service; they are not property, have no cash value, and may not be sold, transferred, shared, or traded except where we expressly permit.

To operate and protect the Service, Avolans and its authorized service providers may access, collect, preserve, review, analyze, copy, disclose, and otherwise process information and content associated with the Service. This includes account, device, authentication, verification, gameplay, match, leaderboard, purchase, support, server, database, network, request, diagnostic, and security-log data, to the extent permitted by applicable law and as described in our Privacy Policy.

We may use automated tools and human review to detect, investigate, prevent, and act on cheating, bots, fraud, abuse, security threats, technical issues, legal violations, and violations of these Terms. You have no expectation of privacy in Service activity or data except as required by applicable law and our Privacy Policy. We may preserve or disclose information when we reasonably believe it is necessary to protect the Service, our users, Avolans, or others; enforce these Terms; or comply with law or legal process.

We want the game to stay fun and fair, so we reserve the right to suspend or limit, edit, restrict, suspend, disable, delete, or terminate any account, device, nickname, content, access, gameplay record, leaderboard position, cosmetic, or entitlement at our sole discretion, with or without notice and with or without cause, to the maximum extent permitted by law. This includes where we suspect foul play, cheating, automation, abuse, harassment, fraud, security risk, inactivity, technical error, legal risk, or any violation of these Terms. We may reset or correct scores, ratings, match results, purchases, or other Service records. We do not owe an explanation, compensation, refund, restoration, or appeal, though we may offer any of these in our discretion where required by law.

• Cheating, exploiting bugs, or using unauthorized third-party software.
• Automating gameplay with bots, scripts, macros, or AI agents (see above).
• Harassing, threatening, or abusing other players or Avolans staff.
• Impersonating another player, Avolans, or Avolans staff.
• Attempting to disrupt, overload, or gain unauthorized access to the service.
• Reverse engineering, decompiling, scraping, data mining, probing, or testing the Service except as expressly permitted by law.
• Evading or attempting to evade an enforcement action, including by creating replacement accounts or changing device identifiers.
• Choosing a nickname that is offensive, impersonating, or otherwise inappropriate.

The Service may offer purchases, restores, or donations through Apple, Google, PayPal, RevenueCat, or other third parties. Their terms, policies, and billing rules apply to the transaction, and the applicable store or provider controls billing, refunds, and chargebacks except where law requires otherwise. We may verify, grant, withhold, revoke, or correct access to an entitlement based on the provider's records, fraud or misuse signals, a reversal or refund, an account action, a technical error, or these Terms. Third-party services are provided under their own terms, and we are not responsible for their availability, acts, omissions, or content.

Fuzzball, its code, art, and branding are owned by Avolans and protected by applicable intellectual property laws. Using the service doesn't give you any ownership rights in it.

Fuzzball is provided "as is," without warranties of any kind. To the maximum extent permitted by law, we disclaim all express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and uninterrupted or error-free operation. To the maximum extent permitted by law, Avolans, its affiliates, and their respective owners, employees, contractors, suppliers, and licensors are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of data, profits, goodwill, reputation, or business, arising from or related to the Service or these Terms. To the extent liability cannot be excluded, our total aggregate liability for all claims is limited to the greater of $100 USD or the amount you paid us for the Service in the 12 months before the event giving rise to the claim.

To the maximum extent permitted by law, you will defend, indemnify, and hold harmless Avolans, its affiliates, and their respective owners, employees, contractors, suppliers, and licensors from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use or misuse of the Service, your breach of these Terms, your violation of law, or your infringement of another's rights.

We may update these Terms at any time. We may provide notice by posting updated Terms, displaying a notice in the Service, requesting renewed acceptance, or by another reasonable method. Changes take effect when posted unless we state otherwise. Your continued use after the effective date means you accept the updated Terms. If you do not agree, you must stop using the Service; we may terminate your access.
